This website is operated by Simply Modern Scents LLC ("Simply Modern Scents," "we," "us"). By visiting our site or purchasing from us, you agree to these Terms of Service, including the policies referenced here (our Refund Policy, Shipping Policy, Privacy Policy, and Diffuser Warranty, available in the site footer). If you do not agree, please do not use the site. We may update these Terms at any time by posting changes here; continued use of the site means you accept them. Our store is hosted on Shopify Inc.

1. Online Store Terms

By using this site you confirm you are at least the age of majority in your state of residence. You may not use our products or site for any illegal or unauthorized purpose, and you may not transmit viruses or malicious code. Violating these Terms may result in immediate termination of service.

2. Products & Orders

Our candles, wax melts, diffusers, and scent oils are handmade in small batches. We make every effort to display product colors and images accurately, but we can't guarantee your screen shows them exactly. We reserve the right to limit quantities, refuse or cancel any order (including orders that appear to be placed by resellers or distributors), and discontinue any product at any time. Prices are subject to change without notice. Returns and exchanges are governed by our Refund Policy.

3. Billing & Account Information

You agree to provide current, complete, and accurate purchase and account information, and to promptly update it so we can complete your transactions and contact you when needed.

4. Subscriptions

Scent oil subscriptions are billed automatically on a recurring basis through our subscription partner until you cancel. By subscribing, you authorize recurring charges to your payment method at the then-current subscription price. You may pause, skip, or cancel anytime through your account or by emailing us; cancellations take effect for the next billing cycle and must be made before your next scheduled charge to avoid being billed. We may change subscription pricing with advance notice — continuing your subscription after a price change constitutes acceptance. Subscriptions ship free. Promotional discounts on subscriptions apply to the first order only unless otherwise stated.

5. Product Safety & Proper Use

Our products must be used as directed:

Candles and wax melts: Never leave a burning candle or warming melt unattended. Keep away from children, pets, drafts, and flammable materials. Burn on a heat-resistant surface and follow all care instructions provided. Wax products can melt in heat — we are not responsible for products damaged by heat exposure after delivery.

Scent oils: For use in diffusers only. Not for consumption, direct skin application, or use in humidifiers or medical devices. Keep out of reach of children and pets. If oil contacts skin or eyes, rinse thoroughly; if ingested, contact poison control.

Fragrance sensitivity: Our products contain fragrance compounds. Individuals with asthma, allergies, fragrance sensitivities, or who are pregnant should review product details and consult a physician before use. Discontinue use if irritation occurs. While our scent oils are phthalate-free and paraben-free, no fragrance product is suitable for everyone.

Electric diffusers: Use only as described in the included instructions, with the supplied power components, and only with Simply Modern Scents diffuser oils. Do not disassemble or modify the device. HVAC-integrated diffusers (such as the SMS330 and SMS1000) must be installed according to the provided instructions or by a qualified installer; we are not responsible for damage to HVAC systems, property, or devices resulting from improper installation, modification, or use of third-party oils. Use of non-SMS oils or unauthorized modification voids the 1-Year Limited Warranty — see our Diffuser Warranty page.

Laundry products: Keep out of reach of children and pets. Not for consumption.

We are not liable for injury, property damage, or loss resulting from misuse, improper installation, or failure to follow product instructions.

6. Accuracy of Information

Occasionally, information on our site may contain typographical errors, inaccuracies, or omissions related to descriptions, pricing, promotions, or availability. We reserve the right to correct any errors and to change or cancel orders if information is inaccurate, including after an order has been placed.

7. Third-Party Links & Tools

Our site may include links to or tools from third parties we don't control. We provide these "as is" and aren't responsible for third-party websites, materials, or services. Please review their policies before transacting with them.

8. User Comments & Submissions

If you send us reviews, photos, ideas, or other materials, you grant us the right to use, edit, and publish them in any medium without restriction or compensation. You agree your submissions won't violate any third party's rights or contain unlawful or abusive content.

9. Personal Information

Your submission of personal information is governed by our Privacy Policy.

10. Prohibited Uses

You may not use the site or its content for any unlawful purpose; to violate any laws; to infringe intellectual property; to harass, abuse, or discriminate; to submit false information; to upload malicious code; to collect others' personal information; to spam or scrape; or to interfere with the site's security features.

11. Intellectual Property

All content on this site — including product names, scent names, photographs, descriptions, logos, and the Simply Modern Scents name and brand — is our property and may not be copied, reproduced, or used commercially without our written permission.

12. Resale Restriction

Products purchased through our retail website are for personal use and gifting only and may not be resold. Wholesale purchasing is available through our wholesale program — contact us or find us on Faire.

13. Disclaimer of Warranties; Limitation of Liability

We don't guarantee that your use of the site will be uninterrupted, timely, secure, or error-free. The site and all products are provided "as is" without warranties of any kind, express or implied, except as expressly stated by us (including our 1-Year Limited Warranty on electric diffusers — see our Diffuser Warranty page). To the maximum extent permitted by law, Simply Modern Scents LLC and its owners, employees, and partners are not liable for any indirect, incidental, special, or consequential damages arising from your use of the site or our products, and our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. In states that don't allow these limitations, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless Simply Modern Scents LLC and its owners, employees, and partners from any claim arising out of your breach of these Terms or your violation of any law or third-party rights.

15. Force Majeure

We are not liable for delays or failures in fulfillment caused by events beyond our reasonable control, including carrier delays, supplier shortages, extreme weather, natural disasters, or government actions.

16. Dispute Resolution

We want to make things right — please contact us first at simplymodernscents@gmail.com, and we'll work in good faith to resolve any issue. Any dispute that cannot be resolved informally shall be resolved by binding arbitration in Ohio on an individual basis. You and Simply Modern Scents each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision by emailing us within 30 days of your first purchase.

17. Severability; Entire Agreement

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms and our posted policies constitute the entire agreement between you and us regarding the site.

18. Governing Law

These Terms are governed by the laws of the State of Ohio and the United States.
